REACH).<\/strong><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-20038\" src=\"https:\/\/epidor.com\/wp-content\/uploads\/2025\/04\/SRT_202210_Certificado_Reach_BLOG_Interior-836x395-1.jpg\" alt=\"Registration, Evaluation, Authorisation and Restriction of Chemicals\" width=\"836\" height=\"395\" \/><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The enforcement of REACH and the penalties to be applied in case of non-compliance are the responsibility of each member state of the European Union within its territory.<\/span><\/p>\n<h3 id=\"anchor2\"><span class=\"ez-toc-section\" id=\"%C2%BFCual_es_el_objetivo_del_Reglamento_REACH\"><\/span>What is the purpose of the REACH Regulation?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">The objective of the REACH regulation is to contribute to the protection of health and the environment from the risks of the manufacture, placing on the market and use of hazardous chemical substances and mixtures.<\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"anchor3\"><span class=\"ez-toc-section\" id=\"Definicion_de_conceptos_incluidos_en_el_Reglamento_REACH\"><\/span>Definition of concepts included in the REACH Regulation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">In order for you to better understand the terms used in the REACH environment, we will briefly define some concepts:<\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #666666; font-size: 15.6px;\"><b>- Substance:<\/b> is any chemical element and its compounds in their natural or manufactured state, including the additives necessary to preserve their stability and any impurity deriving from the manufacturing process used (excluding solvents).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #666666; font-size: 15.6px;\">\u2022 <strong>Article<\/strong>refers to an object with a special shape, surface or design that determines its function, regardless of its chemical composition.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #666666; font-size: 15.6px;\">\u2022 <strong>Intermediary<\/strong>Substance: is any natural or legal person established in the European Community who uses a substance or substances, and who is not a manufacturer or an importer.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #666666; font-size: 15.6px;\">\u2022 <strong>Marketing<\/strong>The supply or making available of an article, against payment or free of charge, by a third party. Importation is considered as commercialization.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #666666; font-size: 15.6px;\">\u2022 <strong>Recipient of an article<\/strong>The final consumer is an industrial user or a distributor to whom an article is supplied. The final consumer is excluded.<\/span><\/li>\n<li aria-level=\"1\"><span style=\"color: #666666; font-size: 15.6px;\">\u2022 <strong>Supply chain<\/strong>The term \"marketing\" means any actor involved in the commercialization of mixtures or articles.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #666666; font-size: 15.6px;\">\u2022 <strong>SVHC<\/strong>Substances of Very High Concern: acronym for Substances of Very High Concern and the name given to a list of substances identified according to the criteria set forth in the Regulation. <strong>REACH<\/strong>.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #666666; font-size: 15.6px;\">\u2022 <strong>ECHA<\/strong>SVHC: acronym for the European Chemicals Agency which manages and publishes the SVHC list and the SVHC candidate list (<em>Candidate List<\/em>). Once a substance is added to this list, obligations are immediately imposed on manufacturers and importers to declare the substances present.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #666666; font-size: 15.6px;\">\u2022 <strong>Article 33<\/strong>Article of the Regulations <strong>REACH<\/strong> concerning the obligation of manufacturers and importers of articles or products to notify their customers of the presence of substances of very high concern in their products if they exceed 0.1 % by weight, as well as to provide instructions for their safe use.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #666666; font-size: 15.6px;\">\u2022 <strong>SCIP<\/strong>database on substances of concern present in articles as such or in complex objects (products) and established under the Waste Framework Directive (WFD).<em>Waste Frame Directive - WFD<\/em>). <a href=\"https:\/\/echa.europa.eu\/es\/scip\" target=\"_blank\" rel=\"noopener\">SCIP<\/a> is an acronym for<em><strong> S<\/strong>ubstances of <strong>C<\/strong>oncern <strong>I<\/strong>n articles as such or in complex objects (<strong>P<\/strong>roducts)<\/em>. <strong>SCIP<\/strong> ensures that information on articles containing substances on the candidate list is available throughout the life cycle of products and materials, including the landfill phase.<\/span><\/li>\n<\/ul>\n<h2><\/h2>\n<h2 id=\"anchor4\"><span class=\"ez-toc-section\" id=\"%C2%BFA_que_productos_quimicos_afecta_REACH\"><\/span>Which chemicals are affected by REACH?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">In the slang of<strong> ECHA<\/strong>, a hazardous substance is labeled as a \u201cSubstance of Very High Concern\u201d (SVHC).<a href=\"https:\/\/echa.europa.eu\/es\/substances-of-very-high-concern-identification-explained\" target=\"_blank\" rel=\"noopener\"><em>Substance of Very High Concern - SVHC<\/em>)<\/a>. Prior to labeling in this way, the substance must be temporarily added to the so-called Candidate List (Candidate List).<a href=\"https:\/\/echa.europa.eu\/es\/candidate-list-table\" target=\"_blank\" rel=\"noopener\"><em>Candidate List<\/em><\/a>), pending the processing of the authorization for its use (annex XIV of <strong>REACH<\/strong>).<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-20042\" src=\"https:\/\/epidor.com\/wp-content\/uploads\/2025\/04\/SRT_202210_Certificado_Reach_quimicos_836x395.jpg\" alt=\"Chemicals regulation Reach\" width=\"836\" height=\"395\" \/><\/p>\n<p style=\"text-align: justify;\">REACH involves the creation of the European Chemicals Agency (<em>European Chemicals Agency - <a href=\"https:\/\/echa.europa.eu\/es\/\" target=\"_blank\" rel=\"noopener\">ECHA<\/a><\/em>) based in Helsinki. This organization is responsible, among many other things, for defining the hazardousness of a chemical substance. The regulation <strong>REACH<\/strong> affects all chemicals except for those that are in the form of a chemical <a href=\"https:\/\/echa.europa.eu\/documents\/10162\/17250\/reach_factsheet_on_communication_obligation_es.pdf\" target=\"_blank\" rel=\"noopener\">explicitly excluded<\/a>.<\/p>\n<p style=\"text-align: justify;\">In addition, restrictions on substances, mixtures or articles are decreed in Annex XVII of <strong>REACH<\/strong>.<\/p>\n<h2><\/h2>\n<h2 id=\"anchor5\"><span class=\"ez-toc-section\" id=\"%C2%BFQuien_esta_obligado_a_cumplir_con_el_reglamento_REACH\"><\/span>Who is obliged to comply with the REACH regulation?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p style=\"text-align: justify;\">Often, one wonders how or in what way the Regulation may affect him or her. <strong>REACH<\/strong>. From manufacture to purchase by the End User of any article and\/or substance, the responsibility affects the entire supply chain.<\/p>\n<p style=\"text-align: justify;\">The manufacturer must notify if its article contains any substance of very high concern and, according to Annex II of <strong>REACH<\/strong>, The final user is the end user, who is the ultimate recipient of the safety data sheet.<\/p>\n<p style=\"text-align: justify;\">Since the candidate list is dynamic, it may happen that some of the components of the formulation of a substance have been included in this list, when previously it was not. This situation is resolved as above, being the responsibility of the manufacturer to notify the supply chain of this circumstance.<\/p>\n<h3 id=\"anchor6\"><span class=\"ez-toc-section\" id=\"%C2%BFComo_cumplir_con_las_disposiciones_de_REACH\"><\/span>How to comply with REACH provisions?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">A manufacturing company, in order to comply with the provisions of <strong>REACH<\/strong>, must <strong>identify and manage the risks associated with the substances it manufactures and markets in the European Union<\/strong>. It must demonstrate how to use such substances safely and must communicate the risks involved and preventive measures to the parties concerned.<\/p>\n<p style=\"text-align: justify;\">The REACH Regulation covers the following processes:<\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"color: #666666; font-size: 15.6px;\"><b>- Registration <\/b>(title II): the manufacturer must register any hazardous substance manufactured\/imported in quantities equal to or greater than 1 ton\/year, according to the procedure established by<b> ECHA.<\/b><\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"color: #666666; font-size: 15.6px;\">\u2022 <strong>Evaluation<\/strong> (Title VI): the risks to health and the environment shall be assessed for that hazardous substance, as established by <strong>ECHA<\/strong>.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"color: #666666; font-size: 15.6px;\">\u2022 <strong>Authorization<\/strong> (Title VII): for the substance of interest, a use authorization must be applied for in accordance with <strong>ECHA<\/strong>. At the end of the authorization procedure, it is ensured that this substance can be progressively replaced by a less hazardous substance(s) when economically and technically viable alternatives are found.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"color: #666666; font-size: 15.6px;\">\u2022 <strong>Restriction<\/strong> (title VIII): if applicable, <strong>ECHA<\/strong> may limit or even prohibit the use of such a substance.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-size: 24px;\">We hope this article has been of interest to you.
